Overview

Court Marriage in Nepal

Court marriage is the legal process of officially registering a marriage through the District Court under the National Civil Code 2017 (Muluki Civil Code 2074). It applies to Nepali couples, mixed Nepali-foreign couples, and two foreign nationals marrying in Nepal.

The court issues an official marriage certificate that serves as legal proof for visa applications, immigration, inheritance, property rights, citizenship matters, and other legal purposes in Nepal and internationally.

⚖️
Legal Basis: Sections 67–84 of the National Civil Code 2017 govern marriage registration in Nepal. Under Section 73, marriage registration is legally mandatory for all couples.
⚠️ A religious or traditional ceremony alone is not legally valid proof of marriage in Nepal unless officially registered at the District Court or Ward Office.

✓

Both Must Be Single

Neither party should have an existing valid marriage. Unmarried, legally divorced, or widowed status is accepted.

✓

Minimum Age: 20 Years

Both male and female must be at least 20 years old — strictly enforced for both Nepali and foreign nationals.

✓

Free Mutual Consent

Both parties must agree freely and voluntarily. No pressure, coercion, or force is acceptable under any circumstances.

✓

No Prohibited Relation

The couple must not be within a prohibited blood relationship under Nepali law.

🌍 Foreign to Foreign Couples: Both foreign nationals must also comply with the marriage laws of their respective home countries. The court may require translated copies of both countries’ marriage laws. We handle both translations.

Your Court Marriage Journey

Exactly what happens — from first consultation to marriage certificate in hand

The court marriage process in Nepal is governed by the National Civil Code 2017. The procedure outlined below follows the prescribed legal requirements. Professional legal guidance and advisory support are available at every stage.

Day 1
🤝

Initial Consultation & Document Review

Both parties attend an initial consultation with citizenship certificates and photographs. The marriage registration application is prepared, and legal guidance is provided on obtaining the Single Status Certificate (Avivahit Pramanpatra) from the Ward Office. This certificate carries a 30-day validity period.

Day 2
🏛️

Application Filed at Kathmandu District Court

The application is submitted at the District Court (Babarmahal, Kathmandu or the relevant local District Court). Documents are examined and eligibility is verified by the court. Both parties and their witnesses sign the Deed of Consent before the Marriage Registration Officer.

Day 3
📜

Marriage Certificate Issued

The judge reviews the submitted application and the court issues the official marriage certificate — usually within 7 days of submission, often sooner. The marriage stands legally registered in Nepal under the National Civil Code 2017.

Day 1–15
🛬

Mandatory Minimum Stay in Nepal

The foreign spouse is required to stay in Nepal for a minimum of 15 continuous days — a legal condition under the Civil Code 2017 that cannot be waived. During this period, temporary residence registration at the local Ward Office is completed to establish the required proof of residency.

Day 16–18
🏢

Embassy Documentation & File Preparation

The No-Objection Letter confirming single status is obtained from the respective embassy. A notarized Nepali translation of the foreign country’s marriage law is prepared. Legal assistance is available throughout the document preparation process to ensure all submissions meet court requirements.

Day 19–24
⚖️

Court Submission & Certificate Issuance

The complete application is filed at the District Court. Both parties and witnesses must appear in person. The Deed of Consent is signed before the Marriage Registration Officer. The judge reviews and approves. The official Court Marriage Certificate is issued within 7 days of the hearing.

📌 Important Note: A minimum of 22 to 24 days in Nepal is recommended for foreign national marriage registration — courts may request additional documents. Legal advisory support is available at each stage to prevent delays.
Before Arrival
🌍

Pre-Arrival Preparation (Both Partners)

Certain embassies — especially German, French, and Chinese — may take several weeks to issue the No-Objection Certificate. Both partners are advised to initiate their embassy NOC applications from their home countries before traveling to Nepal. Guidance on exact timelines per nationality is available upon consultation.

Day 1–15
🛬

Mandatory 15-Day Stay — Both Partners

Both partners must each complete 15 continuous days of stay in Nepal. The count starts from the later-arriving partner’s entry date. Leaving and re-entering Nepal resets the count. Ward Office residence registration is completed upon arrival for both individuals.

Day 1–15
🏢

Dual Embassy NOC & Document Translation

No-Objection Letters are obtained from both partners’ respective embassies. Certified Nepali translations of both countries’ marriage laws are notarized. All foreign-language documents for both partners are translated and notarized as required by the court.

Day 16
📋

Ward Office Certificates — Both Partners

Both partners individually obtain Temporary Residence Certificates from the Ward Office (NPR 10,000 each). These confirm legal residency in Nepal and are a mandatory requirement for the court application.

Day 17–24
⚖️

Court Application, Hearing & Certificate

A joint court application is filed with the complete document set for both partners. Both parties and two witnesses appear at the hearing. Both sign the Deed of Consent. The Marriage Certificate is issued in Nepali, with a certified English translation and MOFA authentication arranged for international use.

📌 Key Note for Foreign-to-Foreign Couples: Following certificate issuance, both partners may require separate embassy attestations at their respective home embassies for recognition abroad. The full authentication chain — MOFA and both embassy attestations — is covered under this service.

Going Abroad?

Using Your Certificate Internationally

If you need your Nepal marriage certificate for a visa, residency abroad, or immigration — it must go through the official 3-step attestation process.

1

Notarization & Translation

You must first get your court marriage certificate notarized by a licensed Notary Public. The notary verifies the document and places their official seal. If your certificate is primarily in Nepali, you will also need to attach a certified, notarized English translation. Usually completed within a few hours to 1 working day.

2

Law Book Management Committee Translation Verification

Before MOFA attestation, the translated documents must be verified through the Law Book Management Committee (कानून किताब व्यवस्था समिति). They authenticate the translation required for foreign use and embassy processing. Usually takes 2–3 working days.

3

Ministry of Foreign Affairs (MOFA) & Embassy Attestation

Submit the verified documents to the Ministry of Foreign Affairs (MOFA), Kathmandu for official attestation. After MOFA authentication, the certificate can then be submitted to your destination country’s embassy in Nepal for final legalization, apostille, or embassy authentication. Processing time typically ranges from 3–7 working days depending on the embassy.

🌍 Foreign to Foreign Couples: The MOFA-attested certificate may need to be presented to each partner’s embassy separately for recognition in their home countries. We coordinate both simultaneously to save time.
Re-Marriage

When Can You Re-Marry?

Under the National Civil Code 2017, a person may re-marry only in the following three conditions:

⚖️

Legal Divorce

The previous marriage was legally dissolved through the court. Divorce decree must be submitted.

🕊️

Death of Spouse

Your previous husband or wife has passed away. Death certificate must be submitted.

📋

Legal Partition

Husband and wife are legally separated through partition in accordance with the law.

⚠️ Attempting to register a second marriage while the first is still legally valid is a criminal offense under Nepali law. Always present valid divorce or death documentation.
