Divorce Law in Nepal
Divorce is the formal legal process of dissolving a marriage between husband and wife through the District Court. Nepal’s National Civil Code 2017 (Muluki Civil Code 2074) governs all aspects of divorce — from filing to property division and child custody.
Either party may initiate divorce proceedings with or without the other’s consent. Divorce-eligible conduct must be reported to a court of law within three months of the date the conduct occurred or the date of knowledge of such conduct.
Both husband and wife agree to end the marriage. Joint petition filed at District Court. Certificate issued same day as written confirmation.
One party files without the other’s consent. Mandatory mediation required. If mediation fails, court grants divorce after 1 year from petition date.

Divorce Process in Nepal

File Joint Petition at District Court
Either spouse files the divorce petition at the concerned District Court with all required documents, stating that both parties mutually agree to dissolve the marriage.
Written Confirmation by Other Spouse
The other spouse submits a written reply on the next working day confirming mutual agreement to the divorce. Both parties must be physically present at court.
Divorce Certificate Issued
Once mutual consent is verified, the Court issues the official divorce certificate on the same day as the written confirmation. The Ward Office updates records and cancels the marriage registration.
File Divorce Petition at District Court
The spouse seeking divorce files a petition at the concerned District Court with grounds for divorce, supporting evidence, and all required documents.
Court Notice to Defendant Spouse
The Court serves formal notice to the other spouse (defendant) through court officials, informing them of the divorce petition and the date of hearing.
Submission of Written Defense
The defendant must file a written reply or defense at the court within the stipulated time period after receiving notice.
Mandatory Mediation
The Court attempts to reconcile both parties through mediation. This is legally mandatory before court proceedings can continue. Approximately one month is provided for the mediation process.
Court Proceedings & Evidence Examination
If mediation fails, the Court proceeds with evidence collection, witness examination, and legal arguments from both parties’ representatives.
Property Partition (if applicable)
If divorce is caused by the husband, the Court orders property partition between spouses before or during proceedings, if the wife demands it.
Final Court Decision
The Court issues final judgment on divorce, property division, child custody, and alimony. Marriage registration is cancelled at the concerned Ward Office.
Prepare Power of Attorney (POA)
Draft a Power of Attorney document authorizing a representative in Nepal (lawyer or trusted family member) to file and manage the divorce proceedings on your behalf. The POA must clearly state all powers granted, specific to divorce.
Notarize & Authenticate at Nepal Embassy
Get the POA notarized by a local notary in your country, then verified and authenticated by the Nepal Embassy or Consulate in your country. Both spouses abroad must issue separate POAs.
Send Original POA to Nepal
Courier the original authenticated POA documents to Nepal. Your legal representative receives the documents and confirms all required paperwork is complete.
Nepal Representative Files & Attends
Your authorized representative files the divorce petition at the District Court and attends all hearings, mediation sessions, and formalities on your behalf throughout the proceedings.

Property & Alimony
Under the Civil Code, the wife has equal entitlement to partition share of the husband’s property. Husband, wife, father, mother, son, and daughter are all considered coparceners.
Equal Property Share
Wife has equal entitlement to partition share. Joint property registered in either or both names is partitioned before divorce if demanded by the wife.
Lump Sum or Monthly Alimony
Instead of property share, the wife may request a lump sum amount or annual/monthly alimony based on the husband’s income and property. This right is forfeited upon remarriage.
Maintenance Costs
If there is no property to partition, the wife may request maintenance costs from the husband based on his income. Stops if wife remarries or her income exceeds husband’s.
Child Custody
Both parents retain rights and obligations toward children after divorce. Custody is determined by the child’s age under Section 101 of the Civil Code.
Mother’s Custody
Mother retains custody regardless of remarriage status.
